Description
Petitioners
Thomas Hawkeswelle of Coleshill and Anneys (Agnes) Hawkeswelle his wife.
Name(s)
Hawkeswelle; Hawkeswelle, Thomas; Anneys (Agnes)
Addressees
Duke of Gloucester, Protector of England.
Nature of request
Thomas Hawkeswelle of Coleshill and Anneys his wife state that when they had sued for four years at common law to recover certain lands and tenements, they finally recovered them and were put in possession on 1 August, 10 Henry V; but that within four days they were forcibly expelled again by Robert Everton, Thomas Everton, John Ferrour, and others. They have sued a writ of trespass against them as far as the venire facias, but the Sheriff and under-sheriff are refusing to serve or return their writs of distringas, and are delaying their case. They ask that they might have proper execution, both of their lands and tenements, and of their wrongs.
Nature of endorsement
The Sheriff of Warwickshire is to be summoned before the lords of parliament by the Treasurer of England to be charged by the same lords to make due execution of the King's commands touching the supplicant of this petition.
Places mentioned
Coleshill in Arden (Coleshill), Warwickshire.
People mentioned
[Humphrey of Lancaster], Duke of Gloucester, Protector of England
Henry V, King of England
Campion, under-sheriff of Warwickshire
Robert Everton
Thomas Everton, brother of Robert Everton
John Ferrour
Richard Hastyng (Hastings), Sheriff of Warwickshire
Thomas Hoor, under-sheriff of Warwickshire.
Note
Richard Hastyng was Sheriff of Warwickshire between 14 February and 13 November 1423, and as the petition suggests that he is still Sheriff, it must date from this period. He was also Sheriff from 1414-1415, which does not fit with the petitioners' recovery of their lands on 1 August 10 Henry V (1422), and from 1426-1427 and 1432-1433, which seem less probable.
