Full description and record details

Reference
SC 8/84/4157
Date
[c. 1335]
Description
Petitioners
John de Eland.
Name(s)
de Eland, John
Addressees
King and council.
Nature of request
Eland requests that the justice be ordered to proceed to judgment in his suit whereby he demanded before the justices of the Common Bench against Earl John for a mill, 100 acres of pasture and 50 acres of wood and it was alleged before the justices that he held only for life by a grant by the king's father of the manor of Sowerbyshire and could not answer without the king whereby the case has been delayed.
Nature of endorsement
Because the record and process mentioned by the petition were heard and examined before the council, by which it is found that the ancestors of the petitioner were disseised as the writ alleged, let it be ordered by writ of the great seal to the justices that they proceed to render judgment according to the verdict of law, and notwithstanding the allegation of the earl, or that the reversion pertains to the king, saving forever to the king his rights.
Places mentioned
Sowerbyshire, [West Riding of Yorkshire].
People mentioned
John [de Warenne, Earl of Surrey].
Note
The justices were ordered to proceed in this case, but not to proceed to judgment without consulting the King on 26 June 1335 (CCR 1333-7, p.413). This would seem to be in response to SC 8/260/12973; and this petition, asking that the justices might be ordered to proceed to render judgment, would seem to date from shortly afterwards.
