SC 8/83/4148
Date
[c. 1297-c. 1299]
Description
Petitioners
Robert de Cumberwell.
Name(s)
de Cumberwell, Robert
Addressees
King and council.
Nature of request
1) Cumberwell requests remedy for the grievances done to him by the prior and his ministers in the Isles arresting his boat and goods without award or judgement. He demanded delivery in court, and offered to answer to the prior, but he could not have delivery, and subsequently the boat was destroyed by the enemy, and the receiver of his goods was killed. He requests that the prior be distrained to render his damages that he has had for his default.2) Cumberwell requests that he be put back in possession of his goods and of the keeping of the church of St Ouen until the king has given his will on this. The prior has put men into the parish of St Ouen of which he had the keeping, and put a parson into the church.1)
Nature of endorsement
The prior answered the petition that he distrained the ship because Cumberwell failed to render an account to the prior when he was bailiff in the Isles, and that Cumberwell refused to render account, and the remainder was distrained by the king's order as some of the goods were stolen from a Portuguese ship. Cumberwell replied that the prior rightly distrained the equipage and goods, but had no other authority to distrain.2) The prior came before the commissioners and presented himself against Cumberwell who was in default, therefore it is considered that the prior is quit and is without a day, and Cumberwell is in default of both pleas.3) To the last petition, the prior replied that he had not placed anyone in the church, nor had anyone done so for him. Cumberwell asserted that the content of the petition was true. Both parties desire that the matter be enquired of by the next commission to the Isles.

Jersey, [Channel Islands].
People mentioned
Henry de Binelard, Prior of Wenlock
Nicholas de Cheny (Cheney)
Henry de Cobham

Otho de Grandison, keeper of the Isles.
Note
The petition can be dated very approximately to c.1297-c. 1299 by a reference to Cumberwell receiving letters of protection to go to Guernsey on the king's business in 1297 and by a suit between the prior and the petitioner in 1299(CPR 1292-1301, p.296; JUST 1/1158 m.1).
