Nature of request
The Prior and convent of Tutbury state that on the Friday after the feast of St Lawrence last, William Burdeleys, John Russel and John de Minores, with two hundred men and more, came to Tutbury, drove the Prior out and enclosed the convent in the chapter house until they had given up their keys and made over the estate of their church to them. Their church is being ruined, and the Prior does not dare to return, so divine service is suffering. They ask that the Prior might be allowed to return safely, and have the keeping of all the goods belonging to the priory, spiritual and temporal, and cure of souls; and that the Prior and convent might be able to find mainprise for the Sheriffs of Staffordshire and Derbyshire, in whose counties their goods are, to appear before the King where he pleases and to be at his ordinance on this matter.

CPR 1301-7 p.353 is dated 3 April 1305, and pp.405-406 is dated 26 October 1305. This is clearly part of the same dispute - the names of two of the malefactors (William Burdeleys and John de Minores) are mentioned in the Patent Roll references, and it would seem that they had connections to Thomas Earl of Lancaster. However, there is no mention there of the Prior being driven from the house, so this petition would seem to be later. Indeed, the words 'soen pere' at the beginning of the second line (unfortunately the end of the first line is damaged) would seem to suggest that it in fact dates from the the reign of Edward II, probably from the early years of that reign. CCW 1244-1326 p.266, a commission to the Chancellor, Treasurer and others of the council, to examine a petition from the Prior of Tutbury and to do justice, dated 12 November 1307, may be connected.
