Nature of request
John de Thornton and Alexander de Eggeburgh state that they brought an assize of novel disseisin against Thomas de Cauncefeld of Ampleforth and others concerning a rent in Exelby, but that Thomas de Cauncefeld, by maintenance of John Sturmy, receiver of writs of the sheriff of Yorkshire, brought an attaint against those on the assize, and procured a false jury of outsiders, changing the jury without judgement by the justices. John, Alexander, and the good people of the jury ask that John Sturmy, whose threats have affected the whole county, might be removed from his office.

He is to sue before the justices where the attaint is pending concerning this maintenance, and justice will be done to him there.

Note
A messuage and two carucates of land in Exelby had been granted (in 1316) to John and Isabel Cauncefeld by John de Helbek, for 12 marks rent. Helbek then granted this rent to Thornton and Eggborough, who in turn alienated it in mortmain to St Leonard's Hospital, York; an inquisition ad quod dampnum was held on 6 February 1335, and the licence was granted on 10 March 1335 (C 143/229/15; CPR 1334-8, p.83). The date of Helbek's grant to Thornton and Eggborough is unknown, but since the novel disseisin was brought by them rather than St Leonards, it seems likely that it dates from before 1335.
