Nature of request
Sibthorp requests that notwithstanding the prior of Wilford is . . . and farmer of the king, and that he has made the king party, that a writ be granted to the barons of the Exchequer to surcease the plea made by the prior, and the prior be warned to sue at the common law as the law demands. The prior has impleaded him in the Exchequer for an annuity and arrears believing the church of Skellingthorpe to be held from him and his successors by way of the annuity. This is not the case and the plea should be heard before the common law.
Nature of endorsement
Because that the prior does not have possession of the annuity from the time that the king was seised of the priory, nor for a long time before, as appears by the arrears now demanded which possession ought because of the plea in the Exchequer for the king's party, and the plea for the annuity is a plea at the common law, and for this let a writ be ordered to the treasurer and barons of the Exchequer to surcease the plea before them of the same annuity. The prior should have his suit in the common bench at the common if he wishes.
