Nature of request
Sutton states that he has been presented before the justices in Holderness for trespasses against the king for building a castle at Bransholme, a fortlet disturbing the arrival into the port of Hull, and possessing a piece of land in Skipsea Castle to the king's disinheritance.1) He states that concerning the castle he has only built a house, but that the justices will not hold an inquisition without advisement of the king.2) Concerning the fortlet he says he has built it to defend the port from the king's enemies who come there.3) Concerning the land in Skipsea castle he and his ancestors have held it from the time of the king and the earls of Aumale and the justices have ordered it to be taken into the king's hand. He requests that it be restored to him and justice be done.4) He further complains that Edward I ejected him from his ferry between Hull and Drypool, and of land from Bilton bridge to Drypool without any allowance being made for him. He requests an inquisition and justice.1)
Nature of endorsement
Concerning the first point let the justices be ordered to hold an inquisition, and if it is found that the castle is a house then he is not to be prosecuted.2) For the second point an inquisition is to be held, and if the fortlet or one chamber is as the petition alleges he is not to be prosecuted.3) Concerning the third point the justices have no power to hold pleas concerning free tenements and he should have a writ to them to make restitution.4) Concerning the fourth point the justices are to hold an inquisition into this and it is to be returned into Chancery and justice will be done.
