Reference
SC 8/69/3412
Date
[c. 1316]
Description
Petitioners
Executors of William de Ros of Helmsley.
Addressees
King and council.
Nature of request
The executors of William de Ros of Helmsley state that because Robert de Ros held part of his lands of the King of the earldom of Aumale, which is in the King's hand, and part of William de Ros, and this by priority of feoffment, William, before his death, challenged the King's right to the marriage of Robert's heir. His executors ask the King and council, in consideration of the Great Charter, to try to whom this marriage belongs.
Nature of endorsement
[Deleted] Coram rege et magno consilio.[Deleted] Per dominum Jacobum de Brincle. The lord King has long been seised of such marriages and their profit, in all cases similar to this one. Therefore it does not seem to the council that the King ought to lose this profit or his long seisin, until something else has been ordained on this by the King and his council in full parliament.
Places mentioned
Hamelak (Helmsley), [North Riding of Yorkshire].
People mentioned
William de Ros
Robert de Ros
James de Brincle.
Note
CCR 1313-8 p.184 is dated 3 June 1315, and would seem to be in response to William's challenge. It states that the original order to the Escheator beyond Trent not to intermeddle further with the lands that Robert de Ros held of lords other than the King was dated 1 June, 4 Edward II (1311). CFR 1307-19 p.295 is dated 16 August 1316, so the petition would seem to date from around then or later.CFR 1307-19 p.243 has no date, but seems to belong to 1310 or 1311.
