Nature of request
John de Pelham states that when he was chief clerk of the office of avenerie in the household of the king's father, the purveyors of the office took victuals from the Abbot of Combe and others for the household's horses; for which the wardrobe is charged. The Abbot of Combe has now sued a writ of trespass in King's Bench against John in Warwickshire, where he has no lands and is not resident, and has procured an inquest, which has condemned him to pay 200 marks. A writ has now been issued for his arrest, and he has sued a writ of attaint against the false inquest. He asks the king to order the Chancellor to give him a writ to the justices of the King's Bench to suspend the order for his arrest, and to make no execution against him at the suit of the king or of the party, so that he can sue this matter to its conclusion.

He is to sue the attaint if he wishes, for the law does not allow him to be mainprized, because of the prejudice to the party which might result.

Note
CPR 1330-4 pp.44 is dated 18 January 1331, and p.223 is dated 12 October 1331. This petition seems to come from a slightly earlier stage in the proceedings, and clearly dates from some time after the succession of Edward III.
