Reference
SC 8/64/3173
Date
[c. 1307]
Description
Petitioners
Roger de Nonaunt.
Name(s)
de Nonaunt, Roger
Addressees
King and council
Nature of request
Nonaunt requests that he be able to have a writ to the justices to proceed in the assize of novel disseisin which he has brought against the Montagu and others for his free tenement notwithstanding the seisin of Queen Eleanor as they do not wish to answer because of a composition made with her.
Nature of endorsement
He should declare before whom the assize is pending and show the composition in Chancery so that it might be seen if the king is bound to uphold the composition, and if it found that the business does not concern the king in such a way that the justices are able to proceed without prejudice to the king, then it should be ordered to them to proceed. If it concerns the king and the justices cannot proceed without prejudice to the king then he should show the composition before the king and council, and there let a remedy be given.
Places mentioned
Devon
Haleford (Halsfordwood), [Devon].
People mentioned
Simon de Mountagu (Montagu)
William de Mountagu (Montagu)
John Bernevill
Eleanor [of Castile], Queen of England.
Note
The petition, as the guard comments notes, is likely to date to early in Edward II's reign as the petition refers to Queen Eleanor as mother of the king, and the petitioner was perhaps exploiting the accession of a new king to promote his claims.
