The petitioners request that Bigod answer concerning an assize of novel disseisin that they have arraigned against him for a tenement in Attleborough. The earl has claimed that he cannot answer without the king though the king has no interest in the tenement.
Nature of endorsement
. . . the justices are to do in this case what has been justly done in other cases. Afterwards the king with his own mouth said that he wished the justices to proceed to take the assize, and also to give judgment if it seems to them for the assise that . . . is to be done before the rendering. . . . the king because the king does not intend by this feoffment or deed to do any injury to anyone, but rather that the earl in such a case . . . and they are to answer as earls ought to answer . . . surrender into the hand of the king.

Note
The petition is likely to date to c. 1305 as Bigod's claim that he could not answer without the king was presumably based on the legitimate point that he had made a settlement with the king that prevented him from disposing of any of his estate in 1302 (Prestwich, Edward I, pp.537-8). The petition is unlikely to be later than 1305 since the earl was forced to acquire a grant of an exception for the manor of Attleborough in March of that year as when he had made the settlement in 1302 which would mean that his estates passed to the crown on his death, he had neglected that he had granted a life interest in that manor to Ralph de Monte Caniso, and the petition cannot be later than December 1306 when the earl died (CPR 1301-7, p.318).
