Nature of request
The petitioners request remedy as they were not named in an assize by which lands that they had let for a term of years in Appleby were taken into the king's hand. Tochet enfeoffed them and the heirs of their bodies of Appleby. They leased it at farm to the prior and convent of Thornholme for 30 years, but they were ejected by Tochet supposing that they were enfeoffed in fee. Eventually by an assize the tenements were seized into the hand of the king because it was found by that assize that the land had been alienated in mortmain.
Nature of endorsement
Because it is accounted by the assize that the tenement mentioned by the petition was alienated in mortmain and the chief lords did not prosecute their right in the time ordained by statute it is considered that the tenements ought to remain in the king's hand by virtue of the alienation
