Reference
SC 8/61/3018
Date
[c. 1307]
Description
Petitioners
Prior of Montacute.
Addressees
King and council.
Occupation
Prior of Montacute
Nature of request
The prior requests that the king will give him seisin of a messuage, land and a water mill in North Cadbury which his predecessor granted to the Moeles for their lives. The Moeles enfeoffed St Amand of the land to the disinheritance of the priory. The prior brought a writ of entry and recovered the tenancy against St Amand, but because collusion was suspected concerning mortmain a writ was ordered to the sheriff of Somerset to examine the judgement, and it was returned that the tenements were held of the king though they were not, and the prior was to sue for them in parliament which he has done.
Nature of endorsement
Let it be ordered by writ of Chancery that they should proceed to do justice, and if there are difficulties by which they cannot act without consulting the king then the king should be certified of that difficulty without delay.
Places mentioned
Montacute, [Somerset]
North Cadbury, [Somerset].
People mentioned
Gwy, Prior of Montacute
John de Moeles
Roger de Moeles, brother of John de Moeles
John de Seynt Amand (St Amand).
Note
The petition is dated on the guard to c. 1307-8. This date seems fair as the petition refers to events in the 35th year of Edward I, and that this is in the previous reign. It seems unlikely that the petitioner would wait too long after the events to seek recovery. As the CIM and CCR refs indicate the manor was still presenting problems for the priory in the early 1330s.
