Nature of request
Richard de Lusteshull states that by virtue of a decision taken at the parliament held at Westminster in the king's fourth year, he sued before the justices of King's Bench to have Roger Bast appear in court to explain why he wrongly removed Richard by force from the wardship of the hospital of St Katharine by the Tower. The case was pleaded as far as judgment, and then, by a command from the king at the quinzaine of St Hilary last, the parties were told to sue to the queen and her council for determination of the matter: but they have done nothing. He requests a final judgment, either before the queen and her council or before the justices.
Nature of endorsement
It seems to the council that cognisance of an expulsion committed during the reign of the late king does not belong to the queen, and that he should have a writ to the justices to proceed to judgment and to do justice.

Dated on the guard to c. 1330, with reference to piece 16, m.2r, of E 175/2 (from the November parliament of 1330) (printed in PROME). However, this is an earlier petition: this petition says that the parliament at which the petitioner was instructed to sue was that held of November 1330. The case then continued to judgment, and was adjourned before the queen's council at 'the quinzaine of St Hilary last': this must be January 1331 at the earliest, and more probably 1332 or even later.The petition enrolled on piece 16, m.2r, of E 175/2 suggests that jurisdiction over this hospital belonged to the Queens of England, and that Richard was first appointed, then expelled (on 2 April 1 Edward III), on the orders of Isabel of France.
