Nature of request
The petitioner seeks the king's special mandate to proceed in a writ of novel disseisin against Richard de Walkerle and others concerning certain tenements in Cumberland. He shows that when he [first] brought the writ, Richard answered that he was unable to take the assize because he held the tenements out of the king's gift, and showed his charter. The petitioner sued to the king to proceed, which was granted provided that he did not dissent from the judgement of king and council. He then sued by petition to the parliament held at Westminster ... Martinmas, year five of [the present] King Edward (1311), to which it was answered that the petitioner ... appealed to the king's council to view the record, which record was returned into chancery the following Hilary term (1312). The petitioner went into chancery and sought a writ to the justices toward ... in the said assize, which he was unable to get without the king's special mandate.
