The petitioner seeks a modification to a [writ of] prohibition concerning a depredation to the law of Holy Church in a Court Christian over a case brought by the petitioner against William de Hoton. He states that one of his predecessors bought the advowson of Awre Church in the diocese of Hereford (having obtained the appropriate licence) from Thomas de Berkeley in year twenty-five of the king (1351-2) and each presentment then held peaceful seisin until Michaelmas in year forty of the king (1366-7), when Hoton submitted to the king that the church was empty (in truth it was filled) and bought a presentment from the king to the said church, by which he was installed therein and took possession and the income from the church to the great impoverishment of the petitioner and the church of Llanthony. For which reason the petitioner pursued the depredation into the court of the Archbishop of Canterbury, until by a prohibition he was prevented from proceeding.
Nature of endorsement
Let the prior have his modification to proceed in a Court Christian on the depredation arising from his attempt to secure the right of patronage to the church. The king allows his suit to the prior by a writ of quare impedit [and] for his right in this part grant him satisfaction.
