Full description and record details

Reference
SC 8/56/2758
Date
[1339-1344]
Description
Petitioners
Alice de Lacy, Countess of Lincoln.
Name(s)
de Lacy; Countess of Lincoln, Alice
Addressees
King and council.
Nature of request
Richard de Kelleshale gave bond to the petitioner in £56 6s 8d by statute merchant before the mayor of Lincoln and the clerk of the statute on Wednesday 23 September 1338. He was to pay her 100s then, and at Whitsun following 100s, and at Christmas following 100s, and at Whitsun following 100s, and at Christmas following 100s, etc., until a final payment at Whitsun (1344) of £6 6s 6d, and certified on record in the chancery. Hugh de Carleton is now dead and the petitioner has sued to Virly to have the rolls inspected and seeks [permission] to sue his executors for delivery of the rolls against her loss.
Nature of endorsement
Let her inspect the certification made before this time and returned into chancery and the letters of obligation of the statute. Let her have the contents of all the terms of payment of the debt that they are in accordance with the letters of obligation. Let her have a writ of execution quit of the certification of the terms passed, and grant her that part [of the debt] not [already] passed.
Places mentioned
Kingston Lacy, [Dorset]
Lincoln, [Lincolnshire].
People mentioned
Edward III, King of England
Richard de Kelleshale of Kingston Lacy
Mayor of Lincoln
Hugh de Carleton, late clerk of the statute merchant
William Virly, clerk of the statute merchant.
Note
The petition must fall between 1338-44 on internal evidence. CPR 1338-40, p.198 would seem to provide a firm dating for the change in personnel of the office of clerk of statute merchant in Lincoln (27 January 1339): but in fact Virly's appointment was superseded by the appointment of Thomas de Carleton on 5 February 1339 (CPR 1338-40, p.202). Adam de Thorpe is then appointed for life on 25 April 1339 (CPR 1338-40, p.254), and Thomas de Carleton is appointed again on 2 August 1340 (CPR 1340-1343 p.14): it seems likely that this is after he chased Thorpe's deputy from the city by threats, as detailed in SC 8/298/14886. SC 8/298/14886 is dated 8 April, possibly 1341, and at this point, the Mayor and people of Lincoln are recommending the re-appointment of Virly. This petition must date either from the brief period of Virly's appointment in 1339, or suggest that he was re-appointed in 1341 or later, in response to SC 8/298/14886.
