Description
Petitioners
Robert de Holewell, executor of the testament of Martin Trye, who was executor of the testament of John de Wyncestre (Winchester)
Name(s)
de Holewell, Robert
Addressees
King and council
Nature of request
Robert de Holewell, executor of the testament of Martin Trye, who was executor of the testament of John de Wyncestre, states that the late John de Bryaunzoun, knight, acknowledged a debt of 40 marks sterling to John de Wyncestre in the Exchequer on 20 May 8 Edward II, which he never paid. Robert therefore sued in the Exchequer, but John's heirs and terre-tenants did not appear when summoned, so, because John had no goods or chattels in the hands of his executors from which the debt could be levied, Robert asked the Treasurer and Barons of the Exchequer that half the lands which John held on the day when he made the acknowledgement might be delivered to him, according to the statute: but they refused to do this, saying that an executor could not have benefit of the statute against an executor. Because he has no other recourse, and it would be great harm to John de Wyncestre's children, who are in his wardship in accordance with the usages of London, if the debt were extinguished, he requests a remedy.

Note
CPR 1338-40 p.179 shows that John de Bryaunzoun was still alive on 4 November 1338, when he was part of a commission de walliis et fossatis, but CPR 1338-40 p.381 shows that he was dead by 16 April 1339, when Thomas de Bradeston is given custody of his lands during the minority of the heir. The petition must therefore date from after that time.CCR 1343-6 p.453 is a reference to Robert de Holewell, concerning the release from the Fleet prison of one Robert son of John de Wynton, who has satisfied him for a debt he owed him, dated 3 August 1344 and is related to piece 126 of SC 1/47, a petition concerning this debt.
