Nature of request
Robert Hereward states that, although he has never been to Norfolk, or committed any trespass against Thomas Roscelyn, Thomas has maliciously purchased a writ of oyer et terminer against him in Norfolk, claiming that he stole his goods in Blakeney, in that county, and committed other trespasses against him; and this has been sued until he has been put in exigent, and does not dare for fear of death to enter that county to stand at law. He requests a remedy, so that he can stand at law somewhere where he can save his life.
Nature of endorsement
Coram magno consilio.Because it is attested before the council that the purchace was made through malice and that he cannot come into the said county without danger of his life, the justices are to be ordered that for these reasons they are to have the record and process, and all other things touching this business, brought before the king; and if he finds sufficient mainpernors in Chancery to appear before the king on a certain day which the Chancellor will ordain, to stand at law, then the Sheriff is to be ordered to suspend the exigent for the aforesaid mainprise.
