Nature of request
Margery, widow of Robert de Botheby, states that a water-course called the Scurth runs from the vill of Bond Burstwick to the Humber between the lands of the king's tenants of the manor of Burstwick and her lands, by which these lands have been drained from time immemorial, but that, under pretext of a letter of the secret seal addressed to Simon de Grymesby, Steward of the manor of Burstwick, at the procurement of the tenants, to make this water-course follow its proper course as it used to, the tenants have maliciously, with force and arms, dug into the banks of the water-course in several places on her land, where it never used to flow, flooding her lands and leading to her destruction if they are not stopped up. She requests that an inquisition be ordered into this, and that, according to what is found by this inquisition, these grievances might be redressed.
Nature of endorsement
Wise and loyal people are to be appointed as justices by a commission of the great seal to survey the former course of the water and to inquire by good and loyal people who are not suspect, and in the presence of the king's Bailiff of the manor of Burstwick, and of the said Margery, and of the others whom this business concerns, if the course of the water is diverted, and if it is found to be so, to return the water to its proper and former course, and to hear and determine this whole business, and to do justice both to the people from the town of Hedon and to Margery and others.
