Description
Petitioners
Executors of the testament of John de Hastyngges (Hastings)
Name(s)
de Hastyngges (Hastings), John
Addressees
King and council
Nature of request
The executors of the testament of John de Hastyngges, who held of the late king in chief, state that after John's death Hugh le Despenser the son, under pretext of wardship of the heir and lands, which he had of the grant of the late king, occupied all John's goods and chattels in those lands, delaying execution of the testament. After Hugh's death they petitioned parliament, and because his lands and tenements were in the king's hand, inquisitions were ordered, which found that Hugh had occupied John's goods in England and Wales to the sum of £773 10s.4d.: so a writ was sent that satisfaction was to be given to the executors, as can be seen from the copy sewn to this petition. But before this could be done, the Earl of March's Steward at Abergavenny, under pretext of the wardship granted to the Earl, occupied the aforesaid goods and chattels, so that now some of them have been spent, some removed, some remain with the Steward, and some lie among the goods and chattels of the Earl which are now in the king's hand. They ask that those that can be found might be delivered to them, and satisfaction given them for the remainder from the goods and chattels which belonged to the Earl, and the debts and arrears due to him.
Nature of endorsement
It is attested before the council that a writ containing the effect of this . . . [the endorsement breaks off here: for a complete version, see SC 8/51/2508].
Places mentioned
Bergeveny (Abergavenny), [Monmouthshire, Wales]
People mentioned
[Edward II], King of England
Hugh le Despenser the son
William de Stanton, Steward of the Earl of March at Abergavenny
[Roger de Mortimer], Earl of March
Note
The original writ to give satisfaction to the executors, SC 8/51/2508, is dated 7 March 1328: but the goods have been occupied again since then, by Roger de Mortimer, Earl of March. This petition must date from after his death on 29 November 1330, as his lands are now in the king's hand. CCR 1330-3 p.105, dated at Westminster 13 January 1331, shows that custody of Abergavenny had by that time been granted to Robert de Middelton - as the petition does not mention this, it may well date from before this.
