Reference
SC 8/47/2318
Date
[c. 1321]
Description
Petitioners
Prioress and convent of Farewell
Addressees
King and council
Nature of request
The Prioress and convent of Farewell state that although the king gave permission to Philip de Somervill to give them 20 acres of waste, held of him in chief, and gave them permission to receive it, John de Swynnerton, Steward of the Forest, is preventing them from enclosing it. They ask that they might be able to enclose it according to the Assize of the Forest.
Nature of endorsement
She is to have a writ in Chancery, containing the force of the petition, that is of Ad quod damnum, to the Justiciar of the Forest or to his lieutenant in the forest of Cannock, in due form, to inquire into what harm would come if the king grants what they request by this petition. And when the inquisition has been returned in Chancery, what is to be done is further to be done.
Places mentioned
Farewell, [Staffordshire]
Forest of Cannock, [Staffordshire]
People mentioned
Philip de Somervill (Somerville)
John de Swynnerton, Steward of the Forest
Note
CPR 1317-21 p.565 is dated at Westminster, 20 February 1321, and seems to be the initial permission rather than the inquiry ordered by the endorsement of this petition. C 81/110 no.5295 and the warrant for C 143/139/12 are both dated 8 June 13 Edward II (1320), and concern the inquisition preceding this permission. It is hard to tell whether this petition or SC 8/47/2322 is the earlier: at first glance 2322 looks earlier, as there is no mention made of their being disturbed in their enclosing of their land: but this petition makes no mention of permission to enclose, indeed asks for it, and it might be that 2322 is merely a more tactful contemporary petition, making no reference of their previous attempts to enclose their land.
