Description
Petitioners
Community of England
Addressees
King and council
Nature of request
The community of England state that people are often indicted for felony in foreign counties and outlawed after their death, so that their goods and chattels are seized into the king's hand. The heirs then try to reverse these outlawries and put themselves on an inquest of the King's Bench that their ancestors died before an indictment or outlawry was pronounced, and the justices refuse to grant a nisi prius to hold the inquest without the king's especial command, causing long and damaging delays. They ask that henceforth inquests in such cases might be held by nisi prius before justices of either bench or before justices of assize.
Nature of endorsement
Coram rege.
Note
Dated tentatively to 1331 on the basis that important legislation was issued during that year on outlawry. It should be noted, however, that the request made here was not immediately reflected in the legislation.
