Nicholas de Ellerker states that he petitioned the last parliament for payment of a debt of 200 marks owed by Edward II to Nicholas and John his brother, whose executor he is, and was granted a writ to the Treasurer, Barons and Chamberlains of the Exchequer to give him payment or assignment. By virtue of this he was granted an assignment to the Prior of Durham, collector of moneys for victuals sold by Edward II, but can have no payment because of two other assignments also made to the Prior, and because the Prior says that he can levy no money. He requests another assignment.
Nature of endorsement
A writ of Chancery is to be sent to the Treasurer, Barons and Chamberlains of the Exchequer that, when they have seen the tally which he has, if they find that others have assignments with the said Prior so that Nicholas cannot be served there, then he is to be assigned elsewhere, where he can be served promptly, receiving the tally.
