Full description and record details

Reference
SC 8/43/2148
Date
[c. 1320-c. 1350]
Description
Petitioners
Bishop of Durham
Addressees
King and council
Occupation
Bishop of Durham
Nature of request
The Bishop of Durham asks that his Chancery might be able to issue writs which were previously made unnecessary by the frequency of eyres and the ease of remedy that way, as he does not dare to issue them now without the king's permission. He therefore asks that he might be able to do justice by whatever writ is necessary, according to their case.
Nature of endorsement
Coram rege et magno consilio. This petition concerns changes in the law, and cannot be done except at the request of the Bishop of Durham and the community of the Diocese, and with the assent of the king and the prelates, earls, barons and other great men of the land, and this in parliament, if anything ought to be done: for which reason nothing can be done at present.
Places mentioned
The franchise (liberty) of Durham and Norhamshire
Note
Dated on the guard to? c. 1327-1333, with reference to Patent and Close Rolls. SCCKB, vol. II::pp.cxlv-vi, however, says that 'this petition apparently belongs to the second half of Edward II's reign or the early years of that of Edward III', and Northern Petitions pp.237-9 (no.175), discussing the related SC 8/44/2165, a contemporary petition on the same subject from the people of the franchise of Durham and Norhamshire, with an identical endorsement in the same hand, dates it to 'post 1345'. Notional dates have been fixed here encompassing the latter part of Edward II's reign but confining the petition to the period before the mid-fourteenth century; the assumption is that the petition has the same date as SC 8/44/2165.
