Description

Name(s)
Draughswerd, Maurice
Addressees
King and council
Nature of request
Maurice Draughswerd states that, for his long service to the king's father, and because of the heavy ransom he had to pay twice when he was imprisoned in Scotland, he was given the alnage of cloth throughout England and half the gauge of wines, but that he has been expelled from this by Nicholas Shirlok, who has wrongly suggested to the king that these offices were vacant. He has complained and petitioned in parliament about this, but has received no remedy. He asks for a scire facias to summon Nicholas before King's Bench or Common Pleas on a certain day to give any reasons he might have why Maurice should not have his offices back; or that the king or his council might examine Maurice's commission for them, and if the law allows it, annul Nicholas' commission and give Maurice his offices back.
Nature of endorsement
Because it seems to the council that the king's charter made to Maurice is of record, because of the wrongs contained in the petition he is to have a writ of scire facias on the said charter against Nicholas, addressed to the Sheriffs of London, where he most frequently exercises his office, that he is to appear in Chancery to show why the office should not be taken into the king's hand and delivered to Maurice. And there, when the commissions of both parties have been examined, and their arguments heard, full justice is further to be done.

Note
CCR 1330-3 pp.391-2 is dated at Westminster, 11 October 1331, and was probably an immediate response to this petition while the council considered the matter. The endorsement then represents their decision.
