John Drax, serjeant at arms, states that in the first year of the king's reign he delivered at York to Thomas Dancastre and John Bernardescastel, Sheriffs of York, a writ of exigi facias on behalf of the executors of James Pikeryng, formerly Sheriff of York, against John, son of Robert Lascy of Gateforth, John Otyr of Hardwick, Adam de Hormeslay, Roger Lagwath and John Harum of Hovingham; by virtue of which the Sheriffs summoned these people to the county court, and when they did not appear endorsed the writ to that effect. However their successors as Sheriffs, John de Wraweby, and Edmund Cottesbrok, erased the endorsement and summoned the people to only some of the county courts held before the date of return of the writ. John Drax has sued for redress of these wrongs for four years, but because of maintenance has not been successful. He asks the king, by authority to parliament, to summon the Sheriffs before his council to answer on these matters; and that they might not be received to make fine without consideration of his great expenses.

Dated on the guard to c. 1406, with reference to the facts that the original writ was delivered on 20 August in the first year of the king's reign (1 Henry IV, 1400) - that the Sheriffs appointed in autumn 1400 did not put it into execution before the date for its return - a month after the following Easter (spring 1401) - and that the petitioner has been suing for redress for four years - which would date this petition to after spring 1405. It says explicitly that it was presented to parliament: so a date at the first parliament after 1405 seems likely - which would be that of March 1406.Thomas Dancastre and John Bernardescastel were appointed as Sheriffs of York at Michaelmas 1399, and John de Wraweby and Edmund Cottesbrokat at Michaelmas 1400.
