The petitioner complains of Rochester that he purchased a writ of mort d'ancestor in the last eyre of Suffolk, 14 Edw. I impleading Theobald de Denham and Robert his son before Rochester, but the suit was delayed for the whole eyre by the procurement of Weylond whom Theobald de Denham's sons had served, and the suit was adjourned to the Bench. His challenge has not been allowed and has been sent back to the Bench where the petitioner cannot pursue his plea because of his poverty, and is destroyed and ruined by the plea and the delays, and will lose his right to his adversaries by his poverty, and dare not reside in the country.1)
Nature of endorsement
Rochester answered and said that that assize was not delayed, because he said that they pleaded to the assize around Lent and that because the Chancery was closed it did not proceed because it seemed to him that the oath acknowledged at that time should be spared. Furthermore he said that it will appear that the assize was delayed for certain reasons concerning another assize and he requests that his rolls might be examined. And he says further that the petitioner remised all his right, and requests judgement.2) And Brompton said that no injury to him was done because the petitioner for some considerable time after pleades against him, and the petitioner came into Chancery and remised all his claim, and he requests judgement. A day is given the Friday after . . . John the Baptist.
