SC 8/40/1988
Date
[c. 1295]
Description
Petitioners
Thomas de Caumvile; Eve de Caumvile, wife of Thomas de Caumvile.
Name(s)
de Caumvile; de Caumvile, Thomas; Eve
Addressees
King and council
Nature of request
The Caumviles show that they have sued before the steward and merchants of the king for three years or more against the executors of William de Say for a substantial debt for which he was bound to them. They have been greatly aggrieved and put to great cost because Elizabeth de Say, an executrix of Say will not come, and without whom the other executors are not able to answer, and they are long delayed. They request remedy or they will be ruined.
Nature of endorsement
Pleas of debt according to the form of Magna Carta ought to be pleaded in the Common Bench, and they should sue there by a writ of Chancery if they wish.
People mentioned
Executors of William de Say
William de Say
Elizabeth de Say.
Note
The petition is dated to c. 1295 as the wardship of Say's heirs and lands was being granted to the earl of Pembroke on 20 November 1295 (CPR 1292-1301, p.167). The petition obviously postdates this, but it is not clear by how long.
