Description
Petitioners
Prior and convent of St Thomas of Canterbury near Stafford.
Addressees
King and council
Nature of request
The petitioners show that they were granted the church of Stow by the earl of Derby before the statute of mortmain. Now Marchomley impleads them in Chancery for the church, saying that he has been presented to it by the king. The petitioners request that the king revoke the presentment.1)
Nature of endorsement
It seems to the council here that it is good if it pleases the king that the king should revoke the presentation made because it would greatly hurt the religious, and be of little benefit to the king if his clerk should sue further in this business.2) Coram magno consilio.
Places mentioned
Stafford, [Staffordshire]
Stow, [Shropshire]
levesche de Cestre (Chester diocese, Coventry and Lichfield diocese)
Lichfield, [Staffordshire]
Coventry, [Warwickshire].
People mentioned
Robert de Ferrers, Earl of Derby
Bishop of Chester (Bishop of Coventry and Lichfield]
Dean and chapter of Lichfield
Chapter of Coventry
Robert de Marchomley.
Note
The petition clearly dates to 1318, and is an example of a matter complained about by petition being resolved very quickly. Marchomley was presented to Stow on 11 April 1318 (CPR 1317-21, p.134). The petition must have followed this very rapidly for the matter was before the Bench where an order was made to the justices to continue the plea until the quinzene of Martinmas so that the prior and convent could produce their charters (CCR 1318-23, p.21). The presentation was then revoked on 8 December 1318 (CPR 1317-21, p.253).
