Date
[1364-1368]
Description
Petitioners
William de Claxton, knight.
Name(s)
de Claxton, William
Addressees
King and council
Nature of request
Claxton shows that he has sued for a long time by a writ of formedon against Drileton in the court of the bishop but has been long delayed by false and imaginary hindrances. Now that the matter is brought to issue Drileton has sued for royal protection by the false allegation that he was about to depart with the duke on his voyage to delay the case to his great damage. Drileton still resides in England and has never served in peace or war, nor is in service. He requests that the protection be revoked, and ordain that such a protection will not be granted in future in delay and disinheritance of him and his suit.
Nature of endorsement
He should sue a writ of deceit to recover his damages if he wishes, and if he wishes to unmake the protection he should sue in Chancery certifying the king if he is still residing in England and has not gone overseas, upon which certification the protection should be repealed.
People mentioned
John de Drileton
Bishop of Durham
[Lionel of Antwerp], Duke of Clarence.
Note
The petition must date between 1364-1368 as the duke of Clarence was arranged in 1364, and he died in 1368 (Cf. Northern Petitions, p.240 for Fraser's dating (CPR 1364-7, pp.10ff)).
