Nature of request
The abbot shows that the justiciar has pursued and distrained him to hold the mills of the earl in Chester against his will. He requests that the earl and justice be commanded that they do not pursue or distrain the abbot to hold the mills for a long time against his will and against the law of the land.1)
Nature of endorsement
The justice of Chester and the treasurer of the earl of Chester are to be called for consultation.2) Because the earl has certified that none of the abbot's predecessors have taken the mills at farm, but has been distrained to hold them by various distraints, and no evidence is shown by which the abbot ought to hold the mills, it seems to the council that the abbot be discharged, and that the abbot make satisfaction to the earl for the arrears for the farm from the time that he had held the mills.3) And after the business was shown before the great council and the things debated, because there was no reasonable cause that the abbot ought to hold the same mills, the abbot is to have a writ to discharge him of the mills according to the endorsement.
