Nature of request

Helme shows that Hendon endowed three chaplains in the church of St Andrew, Holborn, and in the church of St John Zachary of London from certain tenements that he had in the city of London. He has been inducted to one of the chaplaincies by the bishop, but the present tenants of the tenements withhold them from him to his great damage. He requests a remedy be ordained for him so that he can have what pertains to his chantry.

Nature of endorsement

Because previously it has not been possible to have remedy by writ at the common law in cases when tenements are given for such chantries which are alienated by the predecessors of chaplains of such chantries, and now a writ is ordained at the common law out of London and of other franchises by the assent of justices and clerks of Chancery by virtue of a statute in the times of the king's grandfather at Westminster, he should have a writ to the mayor and sheriffs of London founded on his case, and upon his petition that when they have heard the complaint of the chaplain and viewed the testament on the rolls of guildhall and called the parties to make their responses, they should do justice to the chaplain. And let a writ be made in such a case both in a case where tenements are demised and gifts in another manner for such chantries, and also in other cities and vills where tenements are demisable as in London.
