Description
Petitioners
Henry Braken, alien merchant
Name(s)
Braken, Henry
Addressees
King and council.
Places mentioned
London
Westminster.
Nature of request
Braken shows that the king is bound to him in a certain sum of money which he lent to him in the port of London in the first year of his reign for which he has letters patent of obligation sealed under the cocket. He petitioned at the last parliament held at Westminster in his fourth year that he be allowed the sum in the next customs of wool, hide and wool-fells and other merchandises. The petition was answered that the treasurer, barons and chamberlains of the Exchequer be ordered to view the letters, and if they find the debt is still due then they should make payment or allowance as demanded. The treasurer, barons and chamberlains were so commanded and found that the debt was due, nevertheless they did not want to make payment or allowance to Braken's great impoverishment. Braken requests remedy and that execution be made according to the first judgement so that he is not long delayed to his perpetual destruction.
Nature of endorsement
Let it be ordered to the treasurer, barons and chamberlains of the Exchequer that they view the first writ and make execution according to that writ's tenor.
Note
The petition probably dates to 1331, when this matter was fully answered by a writ ordering that the debt be paid or allowance made (CCR 1330-3, p.366). However, the text suggests that the writ may actually have been issued in response to another petition on this matter (SC 8/115/5715).
