Reference
SC 8/35/1745
Date
[c. 1373]
Description
Petitioners
John de Braiton (Brayton); Joan de Braiton (Brayton), wife of John de Brayton.
Name(s)
de Braiton (Brayton); de Braiton (Brayton), John; Joan
Addressees
King and council.
Nature of request
The Braitons state that Fenton was seised of certain lands and tenements in Yorkshire held in socage and of no other land held by knight's service as appears by ancient charters and feoffments. Fenton died five years before the death of Thoresby, Neville's predecessor. The lands descended to Reginald Fenton who was in the keeping of the Braitons until the ministers of the archbishop by his order have seized the lands of the infant held in socage and still detain them without any cause. The Braitons request remedy having regard that they are poor and of little estate and not able to pursue this by the common law without the king's aid.
Nature of endorsement
[None].
Places mentioned
Yorkshire.
People mentioned
Alexander le Nevill (Neville), Archbishop of York
John de Fenton, late husband of Joan de Brayton
John de Thoresby, Archbishop of York
Reginald [Fenton], son and heir of John de Fenton, and son of Joan de Brayton.
Note
The petition is likely to date to early in the pontificate of Archbishop Neville as clear reference is made to the wardship being in the Braitons' hands from the time of the Archbishop's predecessor, it seems unlikely that the archbishop's ministers would wait too long to seize the ward's lands.
