Birthorp shows that there was a dispute between the prior and Birthorp by a prise to be taken by Birthorp by a good accord between them and brought together Coleville, Luttrell, Goband and many other great lords and good people of the country, and they came to the priory to treat with the prior concerning the business, but the prior had his gates closed to speak with them, but after their departure he raised the hue and cry on Birthorp, and by the maintenace of Despenser brought a writ of trespass oyer and terminer against Birthorp and by the inquisition awarded damages of 500 marks to the prior, though no trespass was made. By the prior's malice Birthorp dared not reside in England and went to Ireland, and the prior had him outlawed by which Beaumont seized Birthorp's manor of Birthorpe as chief lord. Birthorp requests that the king grant him a charter of pardon, he also requests that he be able to have restoration of his land.

Concerning the land he should sue at the common law.And concerning the attaint it is to be declared by the great council if it is their intent that the statute is to apply both to inquisitions taken before as to those taken after.

The petition is likely to date to c. 1327 as the petitioner is unlikely to have complained about Despenser until his fall, but it is not clear whether the reference in the petition of Birthorp going to Ireland refers to an actual enforced exile before the fall of Edward II, or to his subsequent appointment as chief baron of the Exchequer in Dublin made on 10 November 1327 (CPR 1327-30, p.188).
