Reference
SC 8/33/1619
Date
[c. 1327]
Description
Petitioners
Thomas de Berkeleye (Berkeley).
Name(s)
de Berkeleye (Berkeley), Thomas
Addressees
King and council.
Nature of request
Berkeleye shows that he brought a writ of Escheat against Fraunceys demanding a messuage in the suburbs of Bristol. Fraunceys came into court, answering as tenant, he vouched to warranty John son of John de Weston. Weston said that he was granted it by letters patent of the king following the forfeiture of Taverner. This cannot be brought to judgement without the aid of the king, and he requests that the king send his writ to the justices of the Bench to proceed.
Nature of endorsement
Let it be ordered to the justices that they proceed in the plea, but they are not to proceed to judgement without the council of the king.
Places mentioned
Bristol.
People mentioned
John Fraunceys (Francis) the younger
John [de Weston], son of John de Weston, knight
John le Taverner.
Note
The petition seems to date to c. 1327. The actual date is based on the guard dating, but Berkeley was involved in a violent dispute with the mayor and several officials of Bristol concerning his right to hold a court in the suburbs of Bristol for which a commission of oyer and terminer was made in August 1330 where Fraunceys appears as one of the bailiffs (CPR 1327-30, p.571).
