Reference
SC 8/31/1509
Date
[1376-1386]
Description
Petitioners
Richard Fitz Alan, Earl of Arundel and Surrey
Name(s)
Fitz Alan, Earl of Arundel and Surrey, Richard
Addressees
King and lords of parliament
Nature of request
Richard, Earl of Arundel and Surrey, states that John Mautravers and John, Bishop of Bath and Wells, have conspired to present one Andrew Baret to the church of Yeovil, vacant after the death of Robert Sambourne, although the advowson of the church belongs to him. He asks that the kind and lords of parliament ordain a remedy, in salvation of his right.
Nature of endorsement
The matter of this petition was more fully debated in parliament and then shown to the king. Because it was attested that a plea is pending both in the King's court by writ of quare impedit, and in Court Christian before the Archbishop of Canterbury, and that this is not yet determined, it is ordained and assented, and willed by the king, that no prohibition or other command should be given to the archbishop or his commissaries to limit their actions in this case while the plea continues, notwithstanding that a plea is pending in the king's court; provided that this is not taken as an example in future.
Places mentioned
Yavele (Yeovil), [Somerset]
the diocese of Bath and Wells
People mentioned
Richard [Fitz Alan], Earl of Arundel and Surrey, father of petitioner
Robert Sambourne, clerk
John Mautravers
John [Harewell], Bishop of Bath and Wells
Andrew Baret
Note
This petition must date from between the death of Richard Earl of Arundel and Surrey, father of the petitioner, in January 1376, and the death of John Harewell, Bishop of Bath and Wells, in July 1386 (although it is perhaps possible that the petition could date from shortly after his death). To narrow the dating down, there are mentions of a Robert Sambourne, clerk, who is possibly the one mentioned here, in CPR 1377-81 p. 160 (dated at Westminster, 20 March 1378) and CCR 1381-5 p.91 (dated August 1381): if these are the same man, he was alive in 1381. CPR 1385-9 p.68, the ratification of Andrew Baret's estate as archdeacon of Wells, is dated at Westminster, 5 November 1385: the petition is likely to have been presented before this.CPR 1374-7 p.286 is dated at Westminster, 1 July 1376.
