John Vivian complains that various servants of Thomas Trethewe, at the command of Thomas and Elizabeth his wife, lay in wait to murder him and his family when they were on pilgrimage to the chapel of St James at Tregoose, on 2 August 12 Edward IV, attacked them, wounded him, his wife, his son and some of his servants, and killed his nephew, and have continued to lie in wait for him and threaten him and his tenants, and have attacked and robbed his manor of Trelowarren, so that he dare not live at home, and his tenants have left. He can have no remedy at common law, because of the power of Thomas and Elizabeth; therefore he asks the commons to ask the king to ordain, by authority of parliament, that he may have as many writs as he needs to the Sheriff of Cornwall, asking him to make proclamation that Thomas, Elizabeth and the others are to appear in person before the King's Bench at the octave of Hilary next, to answer for these crimes, and are to be committed to ward until the matter is determined; with various provisions specified in the petition for particular eventualities.

This petition is enrolled on the roll of the parliament summoned at Westminster in October 1472 (12 Edward IV) and prorogued a number of times until January 1475 (Rot. Parl. vol. VI, p.54a-b). It is stated on pp.52b-53b that the counter-petition was presented on 8 February, 12 Edward IV (1473), and that John Vivian's petition was granted in this parliament, and the writs resulting from it sent out 6 October, 12 Edward IV (1472).
