Description
Petitioners
Thomas Norton of Bristol.
Name(s)
Norton, Thomas
Addressees
Commons in parliament
Nature of request
Norton has a bill before the king's council against Stamford concerning two matters:1) The breaking and erasure of the seals of a deed made by Nele under her seal and that of the mayor of Bristol, granting certain lands in the suburbs of Bristol in fee simple to Combe, who enfeoffed Spelly of parcel of these lands in fee, which land Spelly devised to Norton in his will in accordance with the old custom of the town.2) Stamford brought a false action of debt in the name of Mavyoll in another county, namely Surrey, a process which continued when Norton was outlawed, though there was never any contract between Mavyoll and Norton. The council of Henry V sent a writ to the mayor and bailiffs of Bristol to certify whether Stamford acknowledged the breaking of the seals of the deed, to which they responded as in the annexed schedule. They also summoned Juyn and Long, who testified the same. The bill expired on the death of Henry V, but was authorised and affirmed in the parliament of Henry VI held on 9 November 1422, and the matter was committed to Babyngton and Cokayn, justices of common pleas. Stamford did not appear at the day appointed, so the judges could not determine the case. Norton asks that the deed should have the effect it had before it was broken, and that he should receive costs and damages. He also asks that the judges be given full power to summon and examine Stamford in connection with the case heard in another county, and that he be punished in accordance with the statute of 4 Henry IV against attorneys who bring false suits in foreign shires, and award Norton compensation, with power to make judgement if Stamford defaults.
Nature of endorsement
Concerning the breaking and erasure of the seals of the deed made by Nele to Combe, at the special request of the Commons it is ordained by authority of parliament that the deed be as effectual in law as it was before it was broken, saving to anyone the right they had before it was broken; on the remainder of the petition the plaintiff may have his action at common law.
