Nature of request
The petitioners state that whereas they and Lowther and Morton, who are now dead, as executors petitioned to the parliament held at Leicester in 1426, stating that there had been an error in the record, process and judgement of a plea in the Exchequer between Henry V and the late earl concerning information given to the king, and they requested remedy in accordance with the statute made at Westminster in 31 Edw. III. However the lords of the council are uncertain as to whether they can hear and determine the errors to the great harm of the petitioners. The petitioners request that the record be brought before the council and the execution of the earlier judgement be suspended until the matter has been determined.
Nature of endorsement
The present petition was exhibited to the king in the parliament at Westminster on 8 July 1433 by the commons for the executors, and on 6 December following in parliament it was answered: Let it be just as it is petitioned, taking security that the petitioners will prosecute before the king's council. And if the judgement against the late earl in the Exchequer of the late king is affirmed, then the executors should make satisfaction to the king for the £80 and other sums recovered against the late earl. Also this case is not to prejudice any other cases.
