The duke states that on 12 May 1432 the king granted in his parliament at Westminster that the chancellor have full power to give livery of all those estates to the duke which came into the king's hands by the death of the earl of March and the minority of the duke his heir by Anne the earl of March's sister, saving to the king the right, title and claim of the marriage fine of the late earl. The chancellor made diverse writs to the supplicant directed to diverse escheators in England, but they remained seised in the king's hands because of the marriage fine, and the treasurer and barons intend to take more estates of the late earl into their hand for the fine to the great ruin of the duke if he does not have the king's aid in this, because the late earl had paid much of the fine as appears by tallies levied at the receipt of the Exchequer. The duke requests that the king consider the matter and grant to him his writs to the treasurer and barons of the Exchequer ordering them to allow the tallies and discharge the executors, heirs and land tenants of the earl of the sums paid as part of the fine, and of sums levied by the king's ministers or chargeable to them, and sums levied to the use of the king as appears by record of the Exchequer, and should sums have been levied beyond the extent of the fine, the excess be repaid.
Nature of endorsement
It is ordained on 12 August 1433 at parliament held at Westminster, that considering the matters contained in the petition, letters under the privy seal are to be directed to the treasurer and barons of the Exchequer commanding them to allow the tallies mentioned by the petition, and discharge the executors, heirs and land tenants of the late earl of March of these and other diverse sums levying any sums due to the king, and they are to make livery out of the hand of the king after 12 August all the estates that are in their hands if for no other cause.
