Description
Petitioners
Abbot of the church of Our Lady, Combe.
Addressees
King and the lords spiritual and temporal in parliament.
Occupation
Abbot of the church of Our Lady, Combe
Nature of request
The abbot states that he had by charters of the king's progenitors, and by prescription view of Frankpledge in the vill of Wolvey of both their tenants, and of Giles Astley and his tenants until the view held at Easter last when Astley and his tenants withdrew from the view and were amerced and assessed according to the law. Astley and his men have assaulted the abbot's servants and tried to kill him and his servants. The abbot has a warrant from the justices of the peace of the county for the arrest of Astley and the others to find sureties to keep the peace, but the officers dare not execute the warrant. The abbot requests that a writ is granted to him by the authority of parliament under certain pain against Astley and the others directed to the sheriff of the county, that he proclaim in the vill that they should appear in Chancery and make certain sureties to keep the peace under certain pain, and that the abbot and his servants be able to go about their affairs. If they fail to appear he requests that the chancellor issue another writ directed to the sheriff for them to be taken and put in the county gaol until they pay the fine and find sureties in the form aforesaid.
Nature of endorsement
For the notable causes within the petition it is ordained by authority of parliament that proclamation be made in the vill of Wolvey that Astley and the others appear before the king in Chancery on 12 December next, each of them under £100, to find sufficient surety to keep the peace towards the abbot and other lieges of the king. The £100 is to be forfeit to the king from each of them if they do not appear, and another process be made against them in accordance with the wishes of the petition.
