Nature of request
Multon and Hert state that they and Colles were made the executors of Herrys. After the death of Herrys, Colles took large sums of money that were in the keeping of various people, and also from Herrys' debtors by their common assent, but put it entirely to his own use. He also took chests containing gold and diverse obligations and muniments belonging to the testator by force and arms to Huntingdon whereupon a great dispute ensued between them. The matter was put to the judgement of the bishop of Durham, who adjudged that they should act in common in all matters, and none should act alone, and each made a recognisance in £1,000 to the others concerning this. However Colles continued to make acquittances of large sums to diverse debtors so he could have some of it to his own use, removing himself from their presence and communication, and was impoverished. He did not remain in any certain place and had nothing by which the petitioners could have execution of against him in the common law. The petitioners request that the recognisances be cancelled, and that they be able to receive and administer all Herrys' goods and debts, and sell all the lands and tenements of which they are still enfeoffed so that they can perform the last will and testament of Herrys without Colles. And also that they can pursue in any court that they wish without the name of Colles or his assent. And also that if Colles makes any further releases to anyone of debts due to the testator then they be held entirely void.
Nature of endorsement
The response appears in the roll.(Let it be proclaimed in the town of Huntingdon that John Colles of Huntingdon appear in person before the king in Chancery in the quindene of Easter next to be examined of certain things comprised in the petition, and to say and show anything that he has or knows as to why the petition should not be put into execution. If Colles does appear in Chancery on the day then the chancellor is to have full power to examine him and hear and finally determine these matters according to the desire of the petition or otherwise at his discretion. If he doesn't come then the chancellor has full power to annul the recognisances and to enact the requests of the petitioners in full).
