Nature of request
The commons state that it was ordained by statute at the parliament held at Westminster in 40 Edward III that no misprision of a clerk in whatsoever place it be done should cause the process of a plea to be annulled or discontinued, so that no advantage could fall to the party challenging the plea because of that error. In the parliament held at Westminster on 2 May 1421 the statute was extended so that justices could amend the record and process both before and after judgement as long as it is before them. The ordinance was to last until the next parliament of Henry V. They request that the ordinance and its effect hold force in each record and process both before and after judgement, and endure forever.

Dated by the heading in Rot. Parl. IV, p.295 where it is noted that the petition comes from the parliament held at Leicester on 8 February 1426 (4 Hen. VI). This is noted as one of the common petitions.
