Hugh Morehall complains of a violent attack on a messuage and some land he has leased in Onecote, by Roger Bagenald, Nicholas Bagenald and John Bagenald, on the Monday after the Nativity of Our Lady in the seventh year of the present king's reign - they broke into his house, taking his crops and livestock, assaulting his wife, children and servants, and threatening to kill him if they found him; and they have continued in this way, resisting any attempt to bring them to justice, so that he and his people have been forced to abandon the land. He asks the commons to ask the Duke of Bedford for a writ to the Sheriff of Staffordshire, returnable in the King's Bench at the octave of the Purification, to arrest Roger, Nicholas and John, and also to proclaim in full County Court that they are to surrender themselves to the King's Bench; and if they do not do so, that they might be convicted of these trespasses and ambushes, and all goods and chattels they had on the first day of this parliament forfeit. And if they are captured or surrender themselves, that they might remain in prison, without mainprise, until the octave of the Purification, when they will be put to answer on these matters.
Nature of endorsement
The response to this petition presented in the parliament held at Westminster on 1 December, in the ninth year of the reign of King Henry, the fifth since the conquest, is as appears below.The king's writ will be issued, addressed to each of the Sheriffs of Staffordshire, Derbyshire and Cheshire, to arrest Roger Bagenald, Nicholas Bagenald and John Bagenald, mentioned in this petition, between now and the octave of the Purification next; and the sheriffs are to have them before the King in his Bench at the same octave. And if they cannot be found before the said octave, then each sheriff is to make open proclamation in his County Court, that each of them is to appear in person before the King in the said Bench at the quinzaine of Easter following. And each sheriff is to incur the penalty of £40 if he fails to do this, and he is to inform the said Bench of all his actions in this matter, under his seal, returning his writs there, on pain of the same penalty.
