Robert de Layborne complains that, at the instigation of Thomas Warcop, sheriff of Westmorland, Roland de Thornburgh abducted Margaret, one of the daughters and heirs of Robert de Sandford, and heir apparent of the petitioner's wife, from his wardship in Westmorland, and they hold her, a nine-year-old girl, by force, and have married her to the sheriff's son Thomas. The supplicant is prevented by threats, and by the great power of the sheriff and his kin and supporters, from having a remedy for this. He requests that the malefactors be summoned by writ before the king and lords in parliament, bringing Margaret with them, and that the king give him a remedy. And if there is not enough time in this parliament, then that the council or justices might have power to do this.
Nature of endorsement
Because the plaintiff has offered to submit to the arbitration of two sufficient people on his side, if his opponent will submit to the arbitration of a similar two people on his side, and if the four persons to be chosen cannot come to an agreement, the parties will submit to the judgment of William Gascoigne, the king's Chief Justice, it is agreed by the king and lords that a copy of this petition is to be enclosed in a writ and sent to Roland de Thornburgh and the others mentioned in the petition, so that if they wish to accept the petitioner's offer, they can come to an agreement among themselves, without any other suit. And if they cannot come to an agreement, then both parties, with Margaret, the daughter of the petitioner's wife, are to appear before the king's council at the octave of St John next, on pain of £300, and the council is to have power by authority of parliament to hear the parties and to do justice to them on this matter.

Dated on the guard to '? 1406 cf. rest of batch', with reference also to the List of Sheriffs and William Gascoigne, saying that he was no longer Chief Justice when Warcop was Sheriff for the second time.Thomas Warcop of Lambert's Ash was sheriff between November 1403 and October/November 1406, and again (unless this is the son?) between September/October 1417 and October 1418 - although, as the note says, Gascoigne was no longer Chief Justice then. William Thornbagh, presumably the William de Thornburgh mentioned in the petition, succeeded him on the first occasion, being sheriff between October/November 1406 and October/November 1408.
