Nature of request
The Abbot and convent of Evesham, and also John Cornewaill and Elizabeth his wife, question the validity of the king's gift to John and Elizabeth, and to Hugh Vertot, proctor of the Abbey of Fécamp in England, of the wardship of all the lands and tenements formerly belonging to Fécamp in England, as concerning certain manors in Salmonsbury hundred in Gloucestershire, which seems to be undermined by certain words in an agreement made in the time of Henry III, to resolve the competing claims of the monasteries of Evesham and Fécamp in this hundred. They ask the king, in this present parliament and with the advice of the lords present, to clarify these words.
Nature of endorsement
It is agreed by the king and the lords spiritual and temporal in parliament that this petition should be sent into Chancery, and that the Chancellor, calling to himself the justices, the parties, and other necessary people, is to have power, by authority of parliament, to do justice to the parties, as seems best to him.Whereupon the said Chancellor, calling the parties before him in Chancery, and having heard their arguments in the presence of the said justices, with the aforesaid authority and the advice and assent of the justices, has declared and adjudged that the lands, tenements and possessions contained in this petition are sufficiently amortised by licence of the king, without other licence being necessary from the Abbot of Fécamp, or John Cornewaill or his wife, or Hugh Vertot; and concerning the clause mentioned in this petition, in the agreement between the abbots of Fécamp and Evesham and their convents, that if the hundred of Salmonsbury should at any time be removed from the abbot and convent of Fécamp, the agreement would become invalid until it returned to them, the Chancellor, having carefully examined this clause, because the clause is not relevant, as all Fécamp's possessions are in the king's hand, as of the right of the abbot and convent, because of the wars between England and France, during these wars, and for no other reason, the Chancellor, with the aforesaid authority and the advice and assent of the justices, has declared and adjudged that the agreement remains valid, notwithstanding the said clause.
