Nature of request
John, son and heir of Roger de Burley, kinsman and heir of Simon de Burley, requests that he and his heirs be restored and enabled in law to sue any actions demandable concerning the possession of Simon de Burley, or of any of his ancestors, transmittable through him by descent, notwithstanding the judgement brought against Simon in the parliament of the eleventh year of Richard II, and that this judgment be annulled, so that the blood between Simon and his ancestors, and between John and his heirs, might be restored, as if no judgment had taken place.
Nature of endorsement
The king wills that John, son and heir of the above-mentioned Roger de Burley, and his heirs, should be persons able to sue any actions demandable concerning the possession of the above-mentioned Simon de Burley, or of any ancestor of the said Simon, transmittable through the said Simon by descent, notwithstanding the judgment brought against the said Simon in the parliament in the eleventh year of Richard, lately king of England.

This petition differs from that enrolled on the roll of the parliament held at Westminster in January, 2 Henry IV (1401) (Rot. Parl. III p.464a-b) in that it asks primarily that John and his heirs be enabled to inherit from and through Simon, rather than that the judgment be quashed: in fact, the petition in Rot. Parl. III p.464a-b is more like the earlier petition, SC 8/29/1041, which was given the response that it should be re-cast in the form in which it is found in this petition. The response is similar to the response to this petition, although Rot. Parl. III p.464a-b adds a large series of exceptions. It would however seem to be contemporary to this petition and SC 8/29/1401: perhaps yet another version? The matter clearly dragged on: Rot. Parl. vol. III pp.537b-538b is from the parliament of January 5 Henry IV (1404).
