Nature of request
William de Ashton, parson of the church of Swanscombe, which is of the patronage of the Earl of March, who is under age and in the king's custody, states that the Prior and convent of St Mary Overy (Southwark) sued him in the Court of Arches, to charge his church wrongfully with an annual rent of 5 marks, whereas such pleas should be pleaded in the king's court, and for this reason a writ of prohibition was granted. But in the present parliament, the prior and convent have sued a petition to have a writ of consultation in this plea, notwithstanding the prohibition, and their petition has been endorsed, 'The king wishes the consultation to be granted to the said prior and convent on the matter comprised in their petition, notwithstanding any prohibition made or to be made, but he wishes that his grant not be considered as an example to others in future': which endorsement is completely against the law. He requests that, when the petition and its endorsement have been seen and examined, the king might ordain that no such consultation should be granted if it is not in accordance with the law of the land, and that any consultation purchased in Chancery by virtue of this endorsement be repealed, in salvation of the king's royal jurisdiction, and indemnity of the Earl of March; and that the supplicant might be able to have the common course of the law.
Nature of endorsement
[It is agreed before the king and lords in parliament that the parties are to come] and show before the king's council, between now and next Easter, their right and evidences on both sides; and if it seems to the council that the consultation is reasonable, it is to remain in force, and if it seems unreasonable, it is to be repealed; and in the meantime the consultation is to remain suspended.
